Cancellation and Refund Policy

Effective Date: October 16, 2026 | Version 2026-10-16

1. Scope and parties

This policy governs the customer organization’s software subscription payments to EASYKIDS2GO LLC (“EasyKids”). It applies to transportation companies, schools and daycares contracting for the platform under their accepted order and Terms. Representatives act for the organization with sufficient authority; acting in that capacity alone does not create a personal guarantee.

Charges for transporting families belong to the identified transportation provider under its separate agreement. This policy does not set those charges or authorize transportation charges to parents or drivers. This separation does not eliminate EasyKids’ own obligations or applicable mandatory rights.

2. Monthly plan, price and taxes

Plans are monthly, with no annual commitment. The order must show the platform price, contracted van capacity, currency, applicable taxes, discount and renewal date before acceptance. Charges are based on contracted capacity; leaving some vans unused does not by itself reduce an invoice. Cycles follow the customer’s billing anniversary, not necessarily the calendar month, under the disclosed time and configured timezone in the Terms and order.

Applicable taxes are shown separately. A refund includes any tax adjustment applicable to the transaction; taxes are not automatically treated as nonrefundable. Being called a school or daycare does not itself establish a tax exemption.

EasyKids absorbs its ordinary payment processor fees. It does not add a hidden or payment-method surcharge or deduct those fees from refunds that are due. This does not determine fees the customer’s own bank may charge the customer. Chargebacks or other extraordinary costs are not passed through automatically: any separate claim requires a valid basis and review of the facts and applicable terms.

3. Canceling a manually paid subscription

The organization may cancel future renewals through the cancellation mechanism disclosed in its account or the verified official channel. Cancellation received before renewal stops the next renewal; access for the already-paid period continues until that period ends. Confirmation and the effective cancellation date are provided. There is no ordinary refund of used or remaining time when cancellation is for the customer’s convenience.

Payment is manual through PayPal; automatic payment is not available. Paying an invoice or saving a payment method does not authorize future automatic charges. Canceling the plan is a separate action that stops future renewals; leaving an invoice unpaid does not cancel the subscription or eliminate valid amounts owed. A charge improperly initiated or executed after effective cancellation must be corrected.

Cancellation is not conditioned on accepting another offer. Account closure, van reduction and requesting a refund are different actions and must be clearly presented. Their execution respects custody continuity, pending synchronization events and exit and retention rules; it does not trigger automatic deletion.

4. Exceptions to the ordinary no-refund rule

Duplicate, incorrect or unauthorized payments and charges after effective cancellation are reviewed and corrected. Excess or improper amounts must be refunded with applicable adjustments. Remedies for material breach by EasyKids described below, validly accepted specific commitments and all mandatory rights remain available.

This policy imposes no universal claim-expiration period and does not require waiving valid disputes with a processor, financial institution, court or authority. Duplicate recovery of the same payment is avoided without obstructing those rights.

Refunds and damages are separate. Refunds due under this policy neither consume nor are reduced by the damages caps in Terms section 11 or the DPA. Each refund is limited to the amount actually due, including applicable tax adjustments; calling harm a refund does not create unlimited damages. A refund arising from the same incident does not retroactively reduce its fee base, cap or already determined aggregate. Duplicate and improper charges never increase valid SaaS fees. Only an established overlap in the same amount or harm is adjusted; a refund does not automatically offset distinct damages or entitle Customer to the rest of a cap.

For a later independent incident, prior fee refunds and credits follow Terms section 11's calculation rules: deduct only actual refunds made before the new first event of the same fees counted in its window; retained paid-fee credit keeps its original payment date and is counted once, while a merely promised or unapplied credit is not cash refunded. No prior incident cap or already determined annual aggregate is retrospectively reduced. Customer's separate defense/indemnity obligation under Terms section 12 is not a second refund pool. Scope, exceptions and mandatory rights remain unchanged.

5. Material breach attributable to EasyKids

EasyKids evaluates evidence of a substantial failure of a contracted function or obligation, its scope, duration, recurrence and impact, and addresses correction according to severity. Evaluation includes security, confidentiality and record integrity even if the application still opens. A provider's involvement does not automatically exclude EasyKids's own obligations. A cosmetic inconvenience, nonuse, ordinary cancellation or third-party internet problem alone does not establish such a breach. No arbitrary minimum number of hours is required to recognize a serious incident, and no guaranteed repair time or uptime percentage is established.

Affected service and price allocation

Where a proportional refund is due, it equals valid SaaS fees actually paid after discounts for the affected part of the service, multiplied by the fraction of each fee's actual paid period during which that service was materially impaired. The assessed scope, duration, reliability and viable alternatives will be documented; the outcome is open to complaint and dispute, not EasyKids's unilateral final determination. No full-price amount is refunded when EASY30 or another valid discount reduced the payment. Partial payments are identified by fee line and limited to amounts actually collected. An unpaid invoice may require correction, but money not collected is not refunded.

Formula, intervals and additions

When base and van fees cover the same paid cycle and scope, capacity and price remain constant: Rnet = [B × max(K/N, O) + ΣVi] × t/T. B is the net base fee actually paid; Vi is each materially affected van's net fee actually paid; K is materially affected van capacity; N is contracted van capacity; O is 1 only for the material office-function impairment described above, otherwise 0; t is affected elapsed time and T is the actual paid cycle's elapsed duration. For company-wide essential impairment, all contracted vans are included. If N is zero, no division is performed: the base fraction is O, and only an affected contracted office service can justify that base refund; no nonexistent van fee is invented.

Split the calculation into nonoverlapping intervals whenever scope, capacity, price or paid coverage changes. In each interval j, use Rj = (Bj/TBj) × fj × Δtj + Σ[(Vij/Tij) × Δtij], then sum the intervals. Bj and Vij are the relevant net paid fee lines covering that interval; each T is that line's full actual paid-coverage duration. fj is the base fraction defined above using that interval's contracted capacity and impairment. Each Δt is the overlapping materially affected time within the interval and the corresponding line's paid coverage; a van contributes only while it is affected and covered. Only positive-duration paid coverage is included; a line with no eligible paid amount or no affected covered time contributes zero. A prorated addition uses the amount paid for its remaining coverage and that remaining coverage's duration, not a second proration against the full month.

Time runs from the evidenced start of material impairment of availability or reliability to verified restoration of the affected service, not from the claim date or until the entire investigation closes. Use actual elapsed instants and fractions in the same unit, retaining the displayed timezone and accounting for clock changes; a month is not assumed to have 30 days. Merge overlapping impairment of the same service and time even if causes differ. Keep calculation precision, sum and round to cents at final settlement; allocate cents among fee lines without increasing the total. Track prior refunds so no fee line or paid period is refunded beyond its remaining refundable paid balance or refunded twice. Apply transaction-specific tax adjustments separately and do not deduct EasyKids's ordinary processor fees.

Illustration only: 30-day cycle, 4 vans, base USD99 + 4 × USD65, and 3 affected days; before tax adjustments
Affected serviceNo discountEASY30 on that cycle
One van and its base shareUSD8.98USD6.28
Whole essential serviceUSD35.90USD25.13
Office function onlyUSD9.90USD6.93
Office and one van togetherUSD16.40USD11.48

These reference prices are examples, not a new price offer or evidence of an actual payment. If a fourth van is added halfway through a 30-day cycle for USD32.50 covering the remaining 15 days and is impaired for 3 of those days, its refund plus base share is (99/4 × 3/30) + (32.50 × 3/15) = USD8.98 after final rounding, subject to the remaining paid balance. Dividing the addition by 30 again would undercount its paid coverage. Capacity changes in other intervals require their own base allocation.

Integrity, termination and other remedies

An integrity or security incident without measurable downtime is not automatically valued at zero. Assess which functions or records became unreliable and for what period; where the effect cannot be quantified by time, this availability formula does not settle the case. A specific documented assessment is required without presuming no harm or promising the full month's refund. Investigate missing time evidence without indefinitely delaying a refund due. Other harm, response costs and rights remain separately assessable under Terms section 11 and DPA section 15, without double recovery.

Service credit may be used only if Customer accepts it; it does not unilaterally replace a cash refund that is due. If an ordinary, remediable material breach continues after the Terms' cure period—30 calendar days from valid notice containing reasonably sufficient information—termination for that cause and a refund of unused prepaid amounts from the effective termination date are available. This is not permission to leave defects unattended for 30 days. Exceptions for serious irremediable breach, security, custody, urgency and mandatory rights are preserved; the period does not delay a refund already due.

Exit is coordinated safely, reconciling unused prepaid amounts with sums already refunded for the same fee line and period. Refunds due are outside damages caps as stated in section 4 and are not exclusive remedies or waivers of other applicable liabilities or rights. Direct negotiation and cure may run concurrently when a notice satisfies both requirements; they do not impose a mandatory 60-day wait. Ordinary cancellation, nonuse and ordinary van reduction retain their no-refund rule and all stated exceptions.

6. Changes in van capacity

Adding vans during a cycle requires acceptance of the amount and confirmed payment before additional capacity is enabled. Only the proportional remainder of that cycle is charged, without repeating the base fee. Applicable taxes, effective date and the new monthly total are shown beforehand.

A capacity reduction takes effect at the next renewal, preserving paid capacity until then, without an ordinary refund for that reduction. This policy’s exceptions remain. Vehicle selection or removal and pending trips are reconciled safely under the Terms; reducing commercial capacity does not authorize deletion of vehicles, trips or evidence.

7. EASY30 opening promotion

Code EASY30 provides 30% off the entire first software subscription month: the base fee and all vans in the eligible order. There is no promotional one-van limit, no free month and no free trial. It applies to each company’s first paid subscription; a pilot or preregistered company that has not paid a monthly subscription does not lose eligibility merely because it already has an account. One redemption per company, with no reset by canceling, reactivating or registering again, and no stacking with other codes unless expressly offered. Legally separate companies are not combined solely because they share an owner.

If the company adds vans during that same first promotional cycle, the 30% discount also applies to the prorated amount for those vans, subject to acceptance and confirmed payment. The base fee is not repeated and the cycle or discount is not restarted or extended. The accepted regular price applies from the next renewal. Closing the initial redemption window does not shorten an already-contracted first promotional cycle.

The redemption window will be October 12, 2026 at 00:00 through October 31, 2026, America/New_York; the exclusive cutoff is November 1, 2026 at 00:00. Taxes are calculated as applicable to the transaction; tax itself is not arbitrarily reduced by 30%. Refunds are based on amounts actually paid after the discount and do not refund a price that was never paid.

Reference to EASY30 in these Terms states the governing rules for orders that validly redeem the promotion during the stated opening window while commercial onboarding is enabled; it does not keep the promotion open after November 1, 2026 at 00:00 America/New_York or require EasyKids to enable self-service checkout while billing onboarding is paused.

8. Requesting a refund

The organization’s authorized representative submits a request through easykids2go@gmail.com or the verified refund contact identified in the accepted service order, identifying the company, invoice or transaction, date, amount and reason. Only necessary information is requested; do not send passwords, full card numbers, children’s documents or custody data for a billing question. EasyKids verifies the requester’s authority and the payment without collecting excessive information.

The target is an initial human response within 2 business days after receipt through the official channel, under the support calendar. This is not a resolution deadline and is not satisfied solely by an automated reply. If relevant information is missing, the response identifies it and provides the next step or expected date; investigation proceeds without unjustified delay. Internal approval cannot be used to withhold a due amount indefinitely or displace legally required deadlines.

9. Issuance, destination and receipt

A refund determined to be due is issued or initiated within a maximum of 5 business days after determination or approval, or sooner if a mandatory deadline requires it. EasyKids confirms the amount, applicable tax adjustment and authentic transaction status and provides a receipt. A processing failure is addressed rather than recorded as a completed refund.

The original payment method is used where feasible. Otherwise, a safe, documented alternative is arranged with the holder and processor, without redirecting funds to an unverified account or duplicating a payment. EasyKids service credit is not imposed instead of money due. Final posting depends on the processor and receiving institution; the 5-day period does not guarantee that the money is already available in the customer’s account.

10. Support, changes and complaints

Ordinary support hours are Monday through Friday, 9:00 a.m.–6:00 p.m., America/New_York, excluding United States federal holidays. For this policy’s commitments, business days exclude those weekends and holidays. The two- and five-day periods apply to refunds, not a general support or security SLA; legal obligations and specific commitments are preserved. No 24/7 support is offered.

Material changes to this policy follow the Terms’ notice and effectiveness rules without retroactively altering rights concerning earlier payments. Direct complaints do not restrict urgent measures or other rights preserved there. This policy coordinates with the DPA on exit and data, without treating a payment dispute as authority to delete or improperly withhold information.
